Welcome to Go Mt Kenya Expedition. These Terms and Conditions apply to trekking, hiking, camping, safari, transport, accommodation and other travel services booked through our company. By making a booking, you confirm that you have read, understood and agreed to these terms.
1. About Our Services
We provide guided Mount Kenya trekking and hiking experiences, camping trips, safaris, transportation, accommodation arrangements and related travel services. The exact services included in each booking will be stated in the itinerary, quotation, invoice or booking confirmation provided to the client.
2. Booking and Confirmation
A booking is considered confirmed once:
- The client has accepted the proposed itinerary and price.
- The required deposit or full payment has been received.
- Go Mt Kenya Expedition has confirmed the booking.
Clients must provide accurate information, including names, travel dates, number of participants, nationality where required, dietary requirements, relevant medical considerations and emergency contact details.
3. Payments
The payment schedule will be communicated before confirmation of the booking. Unless otherwise agreed in writing:
- A deposit may be required to secure the booking.
- The remaining balance must be paid before the agreed departure date.
- Bookings made close to the departure date may require full payment at the time of booking.
Prices are based on the services stated in the quotation or booking confirmation. Additional services requested after confirmation may incur additional charges.
4. Prices and Inclusions
The price of a trip depends on the route, duration, group size, accommodation, transport, park fees, meals, guiding and other services selected. The quotation or itinerary supplied to the client will specify what is included and excluded.
Unless specifically stated as included, clients are responsible for personal equipment, international flights, travel insurance, personal expenses, tips, visas, medical expenses and other personal costs.
5. Cancellation by the Client
If a client cancels a booking, cancellation charges may apply depending on how close the cancellation is to the scheduled departure date and on costs already committed to suppliers.
Any refundable amount will be determined according to the agreed booking conditions and amounts that the company or its suppliers are unable to recover. We recommend comprehensive travel insurance covering cancellation, medical treatment, evacuation, baggage loss and other relevant risks.
6. Changes to a Booking
Clients should notify us as soon as possible if they need to change travel dates, route, group size, accommodation, transport or other arrangements. Changes are subject to availability and may result in additional costs.
7. Cancellation or Changes by the Company
We may modify, postpone or cancel an itinerary where reasonably necessary because of severe weather, unsafe mountain conditions, park restrictions, road conditions, government requirements, natural events, operational issues or other circumstances beyond our reasonable control. Where possible, we will discuss alternative arrangements with the client. Safety takes priority over completing an itinerary exactly as originally planned.
8. Mount Kenya and Mountain Safety
Mount Kenya is a high-altitude mountain environment. Trekking involves inherent risks, including difficult terrain, extreme weather, cold, altitude-related illness, falls, injury and other hazards.
Clients must follow the instructions of their guide and staff throughout the expedition. A guide may change the route, schedule, summit attempt or descent when reasonably considered necessary for the safety of the client or group. Reaching Point Lenana or any other summit cannot be guaranteed.
9. Fitness and Health
Clients are responsible for ensuring they are physically prepared for their trek. Before departure, clients should disclose relevant health, dietary, allergy or mobility information that may affect participation. We may recommend medical consultation before a high-altitude trek.
If a client becomes unwell or is considered unable to continue safely, the guide may require the client to descend or leave the expedition. Resulting additional costs may be payable by the client, subject to the circumstances and applicable insurance.
10. Travel Insurance
Travel insurance is strongly recommended and may be required for certain trips. Clients should check that their insurance appropriately covers:
- High-altitude trekking.
- Emergency medical treatment.
- Mountain evacuation where available.
- Trip cancellation or interruption.
- Lost, stolen or damaged baggage and equipment.
- Personal liability.
Clients are responsible for checking that their insurance covers the activities included in their itinerary.
11. Equipment
Clients are responsible for bringing or arranging the personal equipment required for their trek. Equipment or equipment recommendations may be provided where specified in the package. Clients should notify us before departure if they require rental equipment so availability can be confirmed.
12. Guides and Porters
We will arrange guides and porters appropriate to the agreed itinerary. Clients must treat guides, porters, drivers, accommodation staff and other service providers respectfully. Where tipping is customary, clients may tip guides, porters, cooks and other staff at their discretion.
13. Accommodation
Accommodation will be provided according to the selected itinerary and package. Mountain accommodation may include huts, campsites, tents, lodges or other designated accommodation. Accommodation is subject to availability and operational changes; where necessary, we will seek a reasonably suitable alternative.
14. Meals and Special Dietary Requirements
Meals included in a package will be specified in the itinerary or quotation. Clients must inform us in advance of vegetarian, vegan, allergy-related, religious or other dietary requirements. We will make reasonable efforts to accommodate them. Clients with serious allergies should also carry necessary medication and communicate their requirements clearly.
15. Transport
Where transport is included, the type and route will be specified in the booking details. Transport schedules may be affected by traffic, road conditions, weather, mechanical problems, government restrictions or other circumstances outside our reasonable control.
16. Personal Belongings
Clients are responsible for their personal belongings, valuables, documents, money, phones, cameras and equipment. The company is not responsible for loss or damage to personal belongings except where liability cannot lawfully be excluded or limited. Clients should avoid carrying unnecessary valuables during a trek.
17. Client Conduct
Clients are expected to behave responsibly and respectfully throughout the trip. We may require a client to leave an expedition or accommodation without refund if their behaviour creates a serious safety risk, causes significant disruption, damages property or seriously affects other group members. Additional costs arising from such conduct may be charged where legally permitted.
18. Environmental Responsibility
Clients are expected to respect Mount Kenya National Park and the surrounding environment. Clients must:
- Follow designated trails and camping rules.
- Avoid littering and respect wildlife.
- Follow park regulations and guide instructions.
- Avoid damaging vegetation or natural features.
We support responsible and sustainable tourism and encourage visitors to help protect Mount Kenya for future generations.
19. Force Majeure
The company will not be responsible for delays, changes, losses or additional costs caused by circumstances beyond our reasonable control. These may include extreme weather, natural disasters, fire, war, civil unrest, strikes, government restrictions, road closures, epidemics, park closures or other unforeseen events.
20. Third-Party Services
Some services may be provided by independent third parties, including accommodation providers, transport companies, park authorities, equipment providers and other suppliers. We will make reasonable efforts to work with reliable providers but cannot control circumstances arising directly from independent third-party operations.
21. Photography and Marketing
With the client's permission, photographs taken during a trip may be used for marketing or promotional purposes. Clients who do not wish to appear in promotional materials should notify us before or during the trip.
22. Website Information
We make reasonable efforts to ensure website information is accurate and up to date. Itineraries, prices, accommodation, routes, schedules and services may change because of availability, park regulations, weather or operational requirements. The itinerary or quotation confirmed for a specific booking takes precedence over general website information where they differ.
23. Liability
We will provide our services with reasonable care and skill. Nothing in these Terms and Conditions is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law. Subject to applicable law, clients acknowledge that outdoor adventure activities and high-altitude trekking involve inherent risks.
24. Complaints
If a client has a complaint during a trip, they should raise it with their guide or the company as soon as reasonably possible so we have an opportunity to address it. Complaints that cannot be resolved during the trip should be submitted in writing after the trip.
25. Passports, Visas and Travel Documents
Clients are responsible for ensuring they have valid passports, visas, permits, travel documents and other documentation required for their journey. Clients should check current entry and travel requirements before departure.
26. Children and Minors
Clients travelling with children or minors are responsible for ensuring the selected itinerary is appropriate for their age and abilities. A parent or legal guardian must accept responsibility for a minor participating in a trip.
27. Data and Privacy
Personal information provided during booking will be used for booking administration, communication, travel arrangements, safety and customer service. We will handle personal information in accordance with applicable data-protection requirements.
28. Governing Law
These Terms and Conditions are governed by the applicable laws of Kenya, subject to any mandatory legal rights and protections applicable to the client. Disputes will first be addressed through good-faith communication between the parties before formal legal proceedings are considered, where appropriate.
29. Acceptance of Terms
By submitting a booking request, making payment or participating in a trip organised by the company, the client acknowledges that they have read and accepted these Terms and Conditions.
